1. Terms of Use

The client acknowledges having read at the time of the order, the special conditions of sale set out on this screen and expressly accept without reservation.
The present terms and conditions governing the contractual relationship between L'Esprit Joueur and client, both parties fully accept. These general conditions of sale prevail over all other conditions contained in any other document, unless prior written consent.
 

2. Products

The photographs illustrating the products are not part of the contract. If errors occur, shall in no case the responsibility of L'Esprit Joueur not be engaged. The majority of products offered to its customers by L'Esprit Joueur are available in our warehouse. If, however, in the order there was a missing then L'Esprit Joueur undertakes to deliver a reference equivalent.
 

3. Order

The automatic recording systems are considered as proof of the nature, content and date of the order. L'Esprit Joueur reserves the right to cancel any order from a client with whom there is a dispute on the payment of a previous order. The information stated by the buyer, while taking command commit it: if error in the wording of the details of the recipient, the seller can not be held responsible for the inability it could be delivered the product.

5. Payment
The price billed to the customer is the price shown on the order confirmation sent by L’Esprit Joueur. The product price is payable from the effective order date. Payments are made by bankcard bearing the CB logo. CyberMut provides the possibility of paying online via the secure server of the Crédit Mutuel. Your bank card no. is directed to the bank servers, so that your payment is made directly to a bank in a secure environment, without having to pass through the server of the Boutique, ensuring that your details are known only to our bank partner (CREDIT MUTUEL). The order confirmed by the customer is considered effective only when the bank payment centres concerned have given their agreement. In the event of refusal by these centres, the order will be automatically cancelled, and the customer informed by email. In addition, L’Esprit Joueur reserves the right to refuse any order from a customer with whom there is an existing dispute.

6. Disputes

This contract is subject to French law. L'Esprit Joueur may not be held responsible for any loss, damage or injury which may result from the malfunction or incorrect use of the products sold. This also applies to any product modifications made by the manufacturers. While care has been taken to ensure the accuracy of the product information, L'Esprit Joueur will not be held responsible for any minor errors or omissions. In the event of difficulties in the application of this contract, the purchaser has the possibility to attempt to find an amiable solution before taking legal action, in particular with the aid of: a professional association specialised in the sector, a consumer association or any other advisory body of their choice. It should be noted that attempts to find an amicable solution shall have no effect on the “short notice” period of the legal guarantee or the duration of the contractual guarantee. It should be noted that as a general rule, subject to the discretion of the courts, compliance with the provisions of this contract relative to the contractual guarantee supposes that the purchaser honours their financial commitments to the vendor. Complaints and objections shall always be received with attentive goodwill, it being assumed that any customer who takes the trouble to explain their situation is acting in good faith. In the event of a dispute, the customer shall first contact the company to attempt to reach an amicable solution. Failing this, the Tribunal de Commerce de Tours (Commercial Court of Tours) is the sole competent authority, whatever the delivery location and whatever the mode of payment accepted.

7. Legal Information

The provision of personal information for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders, and for the drawing up of invoices and contracts of guarantee. Non-provision of this information shall lead to refusal of the order. In compliance with the French data protection legislation, the processing of this purchase-related personal information is the subject of a declaration to the Commission Nationale de l’Informatique et des Libertés (CNIL, the French data protection authority). The customer has the right to have access to, modify, rectify or remove their personal data (Article 34 of the Act of the 6 January 1978), and may exercise this right by contacting L'Esprit Joueur. In addition, L'Esprit Joueur promises not to divulge or sell its customers’ contact details to any third party.
